اين مقاله در پي توضيح وضعيت حقوقي جنبه هاي خاصي از دكترين مسئوليت حمايت در فراتر ازمرزهاي داخلي است-اين جنبه از تئوري مسئوليت حمايت كه به واسطه ي آن كشورهاي ثالث داراي تعهد جمعي براي حمايت از انسانهايي هستند كه خارج از مرزهاي قلمرو ملي آنها، دچار خشونت گسترده شده، و كشور متبوع قادر به حمايت از آنها نمي باشد-. در این مقاله با مروري بر روند توسعه ي اين مفهوم، مدعي هستيم که در حالي كه قدرت الزام آوري اعلاميه¬ي مسئوليت حمايت تا حدودي ضعيف مي باشد، ديوان بين المللي دادگستري همچنين كميسيون حقوق بين¬الملل، در سالهاي اخير، با صدور اعلامیه های مهمی در این خصوص گامهای مهمی را در راستای توسعه ی تدریجی مفهوم مسئوليت دولتها برای حمایت از افراد خارج از مرزهای ملی خود برداشته اند.

Abstract
This article seeks to clarify the current legal status of a particular
aspect of the ‘responsibility to protect’ principleçthe idea that bystander
states have a collective responsibility to protect populations beyond
borders from mass atrocities when host states fail to do so. It outlines
the development of this idea and argues that, while the legal force of
key international statements on the ‘responsibility to protect’ principle
may be weak at best, the International Court of Justice and the
International Law Commission have offered bold declarations in recent
years which do point towards the gradual development of legal duties
for the extraterritorial protection of populations.
